Terms of Service

These Terms are the agreement you accept when you use Bilingue. We've kept them as plain as we can — what you can expect from us, what we ask of you, and how billing, cancellation, and disputes work.

The short version: be 13 or older, use Bilingue for your own learning, and don't misuse or copy it. Pro subscriptions auto-renew until you cancel, and you can cancel anytime — it takes effect at the end of the period. Disputes are handled by individual arbitration unless you opt out within 30 days (Section 18). Your voice recordings stay on your device. This summary is for convenience only; the full Terms below control.

1.Acceptance of these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Bilingue, LLC (“Bilingue,” “we,” “us,” or “our”) governing your access to and use of our website, apps, and related services. By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is part of them. If you don't agree, please don't use the Service.

Please read Section 18 carefully: it requires most disputes to be resolved by binding individual arbitration and waives your right to a jury trial and to participate in a class action — unless you opt out within 30 days.

If you use the Service on behalf of others in your household (for example, by creating learner profiles for your family), you accept these Terms for yourself and on their behalf, and you're responsible for their use of the Service.

2.Who we are

Bilingue is a speak-first Spanish learning service. The “Service” means our marketing website at bilingue.com, our web app at app.bilingue.com, our iOS and Android apps, and the related content, features, and audio we provide. Bilingue, LLC is a Delaware limited liability company based in Auburn, Washington.

In these Terms:

  • You” means the person using the Service, or the account owner who accepts these Terms.
  • An “account owner” is the person who registers an account and may create additional learner profiles under it.
  • A “learner profile” is a separate profile (for example, for a family member) created within an account.
  • Exercises” are the individual learning units you practice — the speaking, listening, and reading items we schedule for review.
  • Pro” refers to our paid plans, offered as a recurring subscription or a time-limited Pass, as described in Section 5.

3.Eligibility and family profiles

You must be at least 13 years old to create an account and agree to these Terms. If you're under the age of majority where you live, you may use the Service only under the supervision of a parent or legal guardian who agrees to these Terms and takes responsibility for your use. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.

An account owner may create learner profiles for members of their household, including for their own children, and is responsible for each profile they create — for its content and settings, for supervising the learner's use, and for ensuring that use complies with these Terms. The Service is not directed to children under 13, and a child under 13 may not register their own account. See our Privacy Policy for how we handle information associated with learner profiles and children.

4.Your account

You're responsible for your account and for keeping it secure. You agree to:

  • provide accurate account information (such as a valid email) and keep it current;
  • keep your password and login credentials confidential, and not share your account or let others use it;
  • take responsibility for all activity under your account and the profiles within it; and
  • tell us promptly at hello@bilingue.com if you suspect any unauthorized use of your account.

Authentication and password storage are handled through Firebase Authentication; we never see your password in plain form. You can delete your account at any time as described in our Privacy Policy. We may refuse, reclaim, or require you to change a display name that is misleading, infringing, or otherwise objectionable.

5.Subscriptions, billing, and cancellation

Free and Pro

The Service is free to use with a daily limit on the number of reviews you can do. You can start with no account at all at a lower daily limit; creating a free account raises that limit. A paid Pro plan lifts the limit and unlocks additional features. The features and limits of each tier, and the prices and billing cycles available to you, are the ones shown at checkout or in the app. We may change plans, features, and limits as described in Section 17.

The free daily limits, with or without an account, are starting amounts, not guaranteed or permanent ones. The current limits are always the numbers shown in the app, and we may change them, including reducing them, over time as we calibrate the free tiers. Because free use is provided at no charge, a change to a daily limit doesn't entitle you to a refund; if you want a higher or unlimited allowance, you can upgrade to Pro.

Two ways to buy Pro

  • Subscription. A recurring plan billed monthly or annually that renews automatically until you cancel.
  • Pass. A one-time purchase that unlocks Pro for a fixed period of time (offered as an individual or family Pass). A Pass does not renew automatically; when it expires, your access returns to the Free plan unless you buy again.

Free trials

We may offer a free trial of a Pro subscription (currently 14 days). A trial requires a valid payment method, and unless you cancel before the trial ends, it automatically converts to a paid subscription and your payment method is charged the price shown when you signed up. Trials are generally limited to one per person or household, and we may modify or withdraw a trial offer at any time. If you've used a trial before, you may not be eligible for another.

Auto-renewal

Subscriptions renew automatically. At the end of each billing period (monthly or annual), your subscription renews for another period of the same length and your payment method is charged the then-current price, until you cancel. By subscribing, you authorize us — or the app store, for purchases made there — to store your payment method and charge it on a recurring basis. If a charge fails, we may retry it or move you to the Free plan.

How you pay

  • On the web (bilingue.com / app.bilingue.com), payments are processed by Stripe. You enter your card details with Stripe, not with us, and you agree to Stripe's terms. We never receive or store your full card number.
  • In our mobile apps, purchases are made through the Apple App Store or Google Play using in-app purchase. Those purchases are billed by Apple or Google, governed by the store's terms, and managed — including renewal and cancellation — through your store account. See Section 19.

Cancellation

You can cancel a subscription at any time. Cancellation takes effect at the end of the current billing period — you keep Pro access until then, and you won't be charged again afterward unless you resubscribe. To cancel:

  • for a web subscription, use your account settings or the Stripe billing portal we link to; and
  • for an App Store or Google Play subscription, cancel through your Apple or Google account — we can't cancel store subscriptions for you.

Deleting the app does not cancel a subscription. Refunds are covered in Section 6.

Price changes and taxes

Prices may change. If we change the recurring price of your subscription, we'll give you advance notice and the change applies to your next billing period; if you don't agree, you can cancel before it takes effect. Prices are exclusive of taxes unless stated, and you're responsible for any applicable taxes, which may be added at checkout.

6.Refunds

We want you to be able to try Bilingue before you pay — that's what the Free plan and the free trial are for. Apart from the rights below and any the law gives you, payments are generally non-refundable, but we handle requests fairly and case by case.

  • Subscriptions. When you cancel, you keep access through the end of the current billing period; we don't provide partial or prorated refunds for the unused part of a period, except where the law requires it.
  • Passes. A Pass unlocks access immediately for a set time, so it's generally non-refundable once it starts, except where the law requires it.
  • Accidental or duplicate charges. If you were charged in error, charged twice, or couldn't use the Service because of a problem on our end, email us at hello@bilingue.com and we'll make it right, which may include a refund at our discretion.
  • App Store and Google Play purchases. Purchases made through Apple or Google are refunded by the store, not by us, under that store's refund policy. Please request those refunds directly through Apple or Google; we can't issue them.

Nothing here limits any non-waivable refund or cancellation rights you have under the consumer law where you live — for example, statutory withdrawal or “cooling-off” rights in the EEA and the UK.

7.Your license to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial language learning (and, for an account owner, for the learner profiles in your household). This license lasts while your account is in good standing.

You agree not to, and not to allow anyone else to:

  • copy, scrape, crawl, harvest, or systematically download the Service's content, audio, or data, by any automated or manual means;
  • reverse engineer, decompile, or disassemble any part of the Service, or attempt to extract its source code, models, or underlying content, except to the limited extent the law expressly permits;
  • resell, sublicense, rent, lease, or otherwise commercially exploit the Service, or share, transfer, or make your account available to others;
  • access the Service by automated means (bots, scripts, scrapers), or circumvent any rate limit, paywall, plan limit, usage restriction, or security or authentication measure;
  • use the Service or its content to build or train a competing product, dataset, or machine-learning model;
  • introduce malware, interfere with or overload the Service or its infrastructure, or attempt to gain unauthorized access to any account, system, or data; or
  • remove, obscure, or alter any proprietary notices, or misrepresent your affiliation with us.

We may set and enforce limits on use (such as daily review limits or fair-use thresholds) and may suspend or restrict access we reasonably believe violates these Terms.

8.Our intellectual property

The Service and everything in it that we provide — software, design, text, exercises, courses, stories, images, the model audio, the Bilingue name and logo, the “ü” mark, and the overall look and feel — is owned by Bilingue, LLC or our licensors and is protected by copyright, trademark, and other laws. We reserve all rights not expressly granted to you in these Terms.

Our trademarks, logos, and brand features may not be used without our prior written permission. Nothing in the Service transfers any ownership in our intellectual property to you; the limited license in Section 7 is the only right you receive.

9.Your content and feedback

The Service lets you provide a limited amount of content — for example, a display name and avatar, and the reports or messages you send when you flag a problem with an exercise or contact support. You keep ownership of what you provide. You're responsible for it, and you agree not to submit anything unlawful, infringing, offensive, or that isn't yours to share.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use the content you submit solely to operate, provide, and improve the Service — for example, to show your display name on your profile and to review and act on the exercise problems you report.

Feedback. If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose, with no obligation or compensation to you.

Your voice recordings. Speaking-practice recordings are processed entirely on your device and are never uploaded to us, so you don't grant us any license to them. See our Privacy Policy.

10.Acceptable use

When using the Service, you agree not to:

  • break the law or use the Service for any unlawful, harmful, or fraudulent purpose;
  • infringe or misappropriate anyone's intellectual property, privacy, or other rights;
  • upload or transmit anything harmful, harassing, hateful, obscene, or otherwise objectionable;
  • impersonate any person or entity, or misrepresent who you are or your affiliation;
  • interfere with, disrupt, or probe the Service, other people's use of it, or its security; or
  • help anyone else do any of the above.

This is in addition to the license restrictions in Section 7. We may investigate and take appropriate action, including removing content and suspending or terminating accounts, for conduct that violates these Terms.

11.AI-generated content

Bilingue's lessons are created with the help of artificial intelligence. We use Google's generative AI (Gemini) to author much of the learning content — exercises, example sentences, and the stories used for reading and listening — and the model audio you hear is Latin American Spanish produced by text-to-speech. Because this content is generated by AI, it may not always be accurate.

  • AI-generated content may contain errors, inaccuracies, or phrasing that isn't ideal in every context.
  • The Service is for general language-learning purposes only. Its content is not professional advice and is not a substitute for a qualified human translator or interpreter, or for legal, medical, financial, or other professional advice.
  • Please don't rely on the Service for high-stakes, official, or certified translation, and verify anything important independently.

If you spot something that looks wrong, you can report it from within the exercise.

12.Third-party services

The Service relies on third parties, and your use may be subject to their terms. These include Google / Firebase (hosting, authentication, database, analytics, text-to-speech, and Gemini), Stripe (web payments), and the Apple App Store and Google Play (mobile distribution and in-app purchases). The Service may also link to third-party sites or content.

We don't control third-party services and aren't responsible for them. Your dealings with them, and their handling of your information, are governed by their own terms and privacy policies. How we work with these providers, and what data is involved, is described in our Privacy Policy.

13.Disclaimers

We work hard to make Bilingue useful and reliable, but the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from a course of dealing or usage of trade.

We don't warrant that:

  • the Service will be uninterrupted, secure, or error-free;
  • any defects will be corrected, or that the Service is free of harmful components;
  • the content — including AI-generated content and translations — is accurate, complete, or reliable; or
  • the Service will meet your requirements or produce any particular learning result.

You use the Service at your own discretion and risk. Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you.

14.Limitation of liability

To the fullest extent permitted by law, neither Bilingue, LLC nor its owners, officers, employees, or providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to the Service or these Terms — even if we've been advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US $50.

These limits apply across all theories of liability (contract, tort, or otherwise). Some jurisdictions don't allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that can't be limited by law.

15.Indemnification

You agree to indemnify and hold harmless Bilingue, LLC and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your use of the Service; content you submit; your violation of these Terms or of any law; or your violation of anyone else's rights. We may take over the defense of any matter subject to indemnification, and you agree to cooperate.

16.Termination

You can stop using the Service and delete your account at any time. Canceling a paid plan is covered in Section 5; deleting your account and data is covered in our Privacy Policy.

We may suspend or terminate your access — in whole or in part, with or without notice — if you breach these Terms, if we reasonably believe your use creates risk or legal exposure for us or others, or if we stop offering the Service. We may also terminate accounts that have been inactive for an extended period.

If we terminate your paid subscription without cause (for reasons other than your breach), we'll refund any prepaid fees for the period after termination. On termination, your license to use the Service ends. Provisions that by their nature should survive — including Sections 6 through 9 and 13 through 20 — will survive.

17.Changes to the Service and these Terms

The Service. We're always improving Bilingue, and we may add, change, suspend, or discontinue features, content, plans, or limits. We try to avoid disrupting paid features you rely on; if we make a material reduction to a paid plan you've already bought, your remedies are cancellation and the refund terms in Section 6.

These Terms. We may update these Terms from time to time. When we do, we'll post the new version here and update the “Effective” date above, and we'll give you reasonable advance notice of material changes (for example, by email or an in-app message). Changes apply going forward. If you keep using the Service after an update takes effect, you accept the revised Terms; if you don't agree, please stop using the Service and cancel any subscription. Changes to Section 18 are handled as described there.

18.Governing law and disputes

Please read this section carefully. It requires you and Bilingue to resolve most disputes by binding individual arbitration and to waive class actions and jury trials. You can opt out within 30 days of first accepting these Terms (see “Your right to opt out” below), and small-claims cases are excluded.

Governing law

These Terms, and any dispute between you and us, are governed by the laws of the State of Washington — and, for the arbitration agreement, the Federal Arbitration Act — without regard to conflict-of-laws rules. Bilingue, LLC is formed in Delaware and operates from Washington; we've chosen Washington law and venue for disputes.

Informal resolution first

Most issues can be sorted out quickly. Before starting a formal proceeding, please email us at hello@bilingue.com with a description of the problem and what you'd like, and give us at least 60 days to resolve it. We'll do the same for any claim we have against you. This step is required before either of us starts arbitration.

Binding arbitration

If we can't resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be settled by binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by an established arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules, before a single arbitrator. The arbitrator decides all issues, except that a court decides the enforceability of the class-action waiver below. Judgment on the award may be entered in any court with jurisdiction.

Arbitration may take place in the county where you live, or by video or phone, and the seat of arbitration is King County, Washington. The arbitration rules govern fees; we'll pay or reimburse filing fees where those rules or the law require, or where the fees would be prohibitively expensive compared with going to court.

Exceptions

Either of us may bring an individual claim in small-claims court if it qualifies. And either of us may ask a court for an injunction or other equitable relief to stop infringement or misuse of intellectual property or the Service. Doing either does not waive arbitration for other claims.

Class-action and jury-trial waiver

Disputes will be brought and resolved only on an individual basis. You and we waive any right to a jury trial and any right to bring or take part in a class, collective, consolidated, or representative action. The arbitrator may award relief only in favor of the individual party seeking it, and only to the extent needed for that party's claim. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this section still applies.

Your right to opt out

You can opt out of arbitration and the class-action waiver by emailing hello@bilingue.com within 30 days of first accepting these Terms, with your name, the email on your account, and a clear statement that you opt out of arbitration. Opting out won't affect any other part of these Terms. If you opt out — or if the arbitration agreement doesn't apply — disputes go to the courts described next.

Court venue

For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington, and you consent to personal jurisdiction there. To the extent the law allows, any claim must be brought within one year after it arises.

Future changes to this section

If we materially change this dispute-resolution section after you accept it, you may reject the change by emailing us within 30 days of the change, in which case the most recent version you accepted before the change will govern.

19.Apple App Store and Google Play

If you download our app from the Apple App Store or Google Play, the following also applies and controls over anything inconsistent in these Terms for that app.

Apple App Store

  • These Terms are between you and Bilingue, LLC only, not with Apple. Apple is not responsible for the app or its content.
  • Your license to use the app is a non-transferable license to run it on Apple-branded devices you own or control, as permitted by the App Store's Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app. To the extent any warranty isn't effectively disclaimed, Apple may refund the purchase price (if any) to you, and otherwise has no warranty obligation.
  • Apple is not responsible for addressing any product claims (including product-liability, legal or regulatory, or consumer-protection claims) or any third-party intellectual- property claim relating to the app.
  • You represent that you aren't located in a U.S.-embargoed country or on a U.S. prohibited-party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

  • These Terms are between you and Bilingue, LLC only, not with Google. Your use of the app must also comply with the current Google Play Terms of Service.
  • Google is not responsible for the app or its content and has no obligation to provide support or maintenance for it.
  • To the extent we offer any warranty, it's from us, not Google, and Google isn't a party to it.
  • Google is a third-party beneficiary of these Terms to the extent they relate to your use of the app obtained through Google Play, and may enforce them.

Store billing

Purchases made through a store are billed, renewed, canceled, and refunded by that store under its terms, as described in Section 5 and Section 6.

20.Miscellaneous

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service and replace any earlier agreements on that subject.
  • Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest stays in effect.
  • No waiver. If we don't enforce a provision, that isn't a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them — for example, to an affiliate or in connection with a merger, financing, or sale of assets.
  • Force majeure. We aren't liable for delays or failures caused by events beyond our reasonable control.
  • Notices. We may give you notices by email, through the Service, or by posting them here; you can reach us at hello@bilingue.com.
  • No agency. These Terms don't create any partnership, agency, or employment relationship between us.
